A Lasting Power of Attorney is a legal document that allows you to appoint someone, or more than one person, to make important decisions in the future, whether you are physically or mentally incapacitated, so that you can be sure that the right decisions will be made on your behalf.
There are two types of Lasting Power of Attorney:
Financial Affairs: covering your property and bank accounts and investments.
Health and Wealth Welfare Decisions: to include the use of antibiotics to surgery and whether the care home is appropriate.
The difference between a Will and Lasting Power of Attorney is that a Will takes effect when you die, and a LPA takes effect whilst you are living.

Often referred to as a “living Will”, Lasting Powers of Attorneys allows you to appoint one or more (up to four) people as your attorneys to help you make decisions or make decisions on your behalf should you lose mental capacity to make certain decisions for yourself. Without this documentation in place, your loved ones cannot act on your behalf.
There are two Lasting Power of Attorneys which can be put in place; in relation to your Health and Welfare, and in relation to your Property and Financial Affairs. We will advise you on the implications of appointing attorneys to make financial decisions on your behalf and on the appointment of attorneys to make decisions about your health and welfare.
We will explain the implications and the process of establishing the appointment of your attorneys through the Court of Protection and the Office of the Public Guardian. We will prepare a notice of intention to apply for the registration of a Lasting Power of Attorney, as is required, and correspond with your proposed attorneys. We will provide the certificate in relation to the Prescribed Information and make the application(s) to the Office of the Public Guardian. On receipt of the registered copies, we will advise you accordingly.
