Planning for the future is an essential step in safeguarding your assets and ensuring that your wishes are respected. At T.G. Collins Solicitors, located in both Chelmsford and Benfleet, we provide professional and compassionate assistance with setting up a Lasting Power of Attorney (LPA). This legal arrangement allows you to appoint someone you trust to make important decisions on your behalf, should you ever become unable to do so yourself.
A Lasting Power of Attorney is a legal document that allows you to appoint someone, or more than one person, to make important decisions in the future, whether you are physically or mentally incapacitated, so that you can be sure that the right decisions will be made on your behalf.
There are two types of Lasting Power of Attorney:
Financial Affairs: covering your property and bank accounts and investments.
Health and Wealth Welfare Decisions: to include the use of antibiotics to surgery and whether the care home is appropriate.
The difference between a Will and Lasting Power of Attorney is that a Will takes effect when you die, and a LPA takes effect whilst you are living.
If you’re combining Wills with your LPA’s, then we can discuss a fixed fee package.
With years of experience in lasting power of attorney paperwork, our team at T.G. Collins is dedicated to providing a seamless experience. We make sure all legal requirements are met and help you select the right people for these critical responsibilities.
Key Benefits of a Lasting Power of Attorney
It may be that you have suffered a serious brain injury, illness or dementia and don’t have a Lasting Power of Attorney. It does not mean that it’s too late to help. We can help apply for Deputyship at the Court of Protection and your appointed Deputy can act on your behalf when it comes to property, financial affairs and personal welfare.
Don’t leave decisions to chance – it is far better to have peace of mind with a Lasting Power of Attorney.
Often referred to as a “living Will”, Lasting Powers of Attorneys allows you to appoint one or more (up to four) people as your attorneys to help you make decisions or make decisions on your behalf should you lose mental capacity to make certain decisions for yourself. Without this documentation in place, your loved ones cannot act on your behalf.
There are two Lasting Power of Attorneys which can be put in place; in relation to your Health and Welfare, and in relation to your Property and Financial Affairs. We will advise you on the implications of appointing attorneys to make financial decisions on your behalf and on the appointment of attorneys to make decisions about your health and welfare.
We will explain the implications and the process of establishing the appointment of your attorneys through the Court of Protection and the Office of the Public Guardian. We will prepare a notice of intention to apply for the registration of a Lasting Power of Attorney, as is required, and correspond with your proposed attorneys. We will provide the certificate in relation to the Prescribed Information and make the application(s) to the Office of the Public Guardian. On receipt of the registered copies, we will advise you accordingly.
There are many factors to consider when making Lasting Power of Attorneys so please contact us to arrange an initial consultation with our team.

We recently completed a very complicated sale of a leasehold property and I wish to thank Mindi and Aryan and the whole team at T.G.Collins for their tireless efforts to resolve all the problems faced. Their professionalism, friendliness and patience were second to none. All the team members are approachable, any email enquiries were always answered promptly and unlike many solicitors' practices you can actually pick up the phone and talk to your case handler. Their fees are very reasonable, too. I would happily instruct them again and recommend them without any hesitation. Collins Solicitors to write our wills. From the very first contact with Taylor Ellmore (Trainee Solicitor) we felt relaxed and confident that we were receiving sound advice. Taylor guided us through the process and explained everything clearly. We thought it was going to be a difficult process but Taylor made it feel easy. She was able to answer all our questions and was at hand when we needed information and clarification. She was very professional but had a very personal touch which made us feel at ease. Our decision to opt for T.G. Collins was because of Taylor. We would have no hesitation in recommending Taylor Ellmore/T.G. Collins Solicitors.
