Divorce
The most significant change to divorce law since 1969, the Divorce, Dissolution and
Separation Act 2020 came into force on 6 April 2022. A new blame-free basis for obtaining a divorce was introduced, allowing joint applications. The process is undertaken almost entirely online and service by email is the default method.
An applicant or petitioner is the person who initiates the divorce or dissolution proceedings. The other party is the respondent to the application.
The term divorce relates to marriage. Dissolution is the term used to describe the process by which a civil partnership is legally ended.

Divorce and dissolution applications cannot be made until one year from the date of marriage or civil partnership. In practice, the application cannot be made until one year and one day have passed.
Parties who separate before a year has passed may still apply to legalise their separation.

A legally recognised marriage or civil partnership is binding and can only be ended on death, divorce, dissolution, or nullification. The first issue to determine is whether the marriage or civil partnership is legally recognised. If the relationship is not legally recognised, alternative applications such as those for an annulment might be appropriate.
To be legally recognised, all marriages and civil partnerships taking place in England and Wales must satisfy the applicable legislative criteria, and the parties must:
Evidence that the parties’ marriage or civil partnership is legally recognised will be required.
This is usually the marriage certificate or certificate of registration of a civil partnership. For unregistered or overseas marriages and relationships, alternate and usually more detailed evidence may be required, including a formal translation of the document if the original is not in English or Welsh.
Same sex couples can marry under the Marriage (Same Sex Couples) Act 2013 and are required to meet the same requirements as opposite sex couples.

A civil partnership is a legal partnership between two people. Previously only available to same sex couples, opposite sex couples can also enter into civil partnerships following introduction of the Civil Partnership (Opposite sex Couples) Regulations 2019.The same restrictions apply as for marriage. A civil partnership must be registered in England or Wales.
Cohabitation refers to two people living together for which there is no legal definition.
Common law marriage is not a recognised legal relationship under the laws of England and Wales. Cohabiting parties can simply separate without the need for any legal procedures to end the relationship.
Only one application may be made with respect to a marriage or civil partnership unless the first application has been dismissed or determined, or the court grants permission.
Applying for a divorce is the same regardless if the couple is a same-sex or opposite-sex couple. It is also the same procedure to dissolve a civil partnership.
Practitioners must complete applications for divorces and dissolutions online via MyHMCTS. Litigants in person may use the paper process – the D8 Application for a Divorce or Dissolution form.
Either party can make the application, or both parties may make a joint application.
Either party can make an application for a conditional order, or both jointly. The application
may only be made at least 20 weeks after the divorce application was issued and provided:
The application form includes a statement noting any changes, confirming that the contents are true and confirming signatures on the acknowledgement of service where the non-applying party had signed it.
If the judge is satisfied that the applicant is entitled to a conditional order the court will send the applicant a certificate of entitlement. This certificate will provide a date and time when the conditional order will be pronounced at court. The process is a formality, and attendance is not required unless costs are in dispute. The order is the preliminary stage to the divorce and does not dissolve the marriage or civil partnership. Instead, it proves that the court has accepted that the relationship has irretrievably broken down.
When to apply
An application for a final order may be made six weeks and one day after the date of the conditional order. This period is intended to give both parties an opportunity to change their minds.
If financial matters between the parties have not yet been resolved and a final financial
order has not been issued, then it may be advisable to delay applying for the final order.
